Terms of Service

The deal, in about a thousand words.

One person runs this. These terms say what you get, what you owe, and where the limits are.

01The agreement

These terms are a contract between you and the operator of StreetPainter. By signing in and using the service you accept them. If you do not accept them, do not sign in.

How your data is handled is set out in the Privacy Policy, which forms part of these terms.

You must be at least 16 to use StreetPainter.

02Access is invite-only

StreetPainter is not open to the public. Accounts are created only for email addresses on an allowlist held by the operator. An invitation is a permission, not a purchase and not a promise: it can be withdrawn.

We may revoke access at any time, with or without notice, if you break these terms, if your use threatens the service or other users, or if we stop offering the service. Where the circumstances allow it, we will tell you first and give you a chance to export your data.

The service is currently free. If that ever changes, you will be told well in advance and will never be charged without agreeing to it first.

04Acceptable use

Use StreetPainter as a person tracking their own runs, walks and rides. Specifically, you agree not to:

If you break these rules we can suspend or delete your account. Deliberately faking coverage is grounds for removal on its own.

05Your data stays yours

You own your activity data — your tracks, your routes, your posters, your names and notes. Nothing in these terms transfers ownership of any of it to us.

To actually run the service, we need a narrow licence from you. By using StreetPainter you grant the operator a non-exclusive, worldwide, royalty-free licence to host, store, back up, process, transform and display your content solely for the purpose of providing StreetPainter to you: matching your tracks to streets, computing your coverage, rendering your maps and posters, generating your exports, and showing your contribution to crews you have joined.

Scope of the licence

This licence exists to make the app work and for no other reason. It does not let us publish your data, license it to anyone, use it in marketing, or sell it. It ends when you delete the content or your account, except for backup copies that expire on the cycle described in the Privacy Policy.

You are responsible for what you share. Posters and activities you deliberately publish by link can be seen by anyone holding that link. If a track passes your front door, use privacy zones before you share it.

Aggregate, fully anonymised statistics that cannot be traced back to you or to any individual track — for example, "the median covered share of a city" — may be used to describe the service. Nothing identifying you is included.

06Accuracy and your safety

Important

Planned routes are not safety-checked. StreetPainter draws a line over a map. It does not know about traffic, roadworks, closures, one-way restrictions in every case, surface conditions, lighting, crime, weather, or whether a path is a legal or sane place to run or ride. A route it suggests may be dangerous, illegal to use, or may not exist on the ground any more.

You are responsible for your own safety. Look where you are going, obey the law, and use your judgement over the app's.

Coverage matching and route planning are best-effort. Matching decides whether a GPS track covered a given street segment, and it can be wrong in both directions: streets you ran may not be credited, and streets you did not run occasionally may be. GPS is imprecise, especially among tall buildings and under tree cover. Street data comes from OpenStreetMap and is only as current and correct as OpenStreetMap is.

Distance, pace, elevation and coverage percentages are estimates. Do not use StreetPainter figures for anything where precision matters — a race result, an official record, a medical or training decision that ought to come from a professional.

We do not guarantee that the service will be available, that imports will succeed, or that your data will never be lost. We take backups and we try hard, but you should keep your own copy of anything you cannot bear to lose. The data export exists for exactly this.

07Third-party services and data

StreetPainter is built on other people's work, and their terms apply alongside ours.

Strava
If you connect Strava, your use of Strava and of the data that comes from it is governed by Strava's own terms of service and API agreement. We are not affiliated with or endorsed by Strava. Strava may change or withdraw its API at any time, which could break imports here with no notice to us.
OpenStreetMap
Street and path data comes from OpenStreetMap. Map data is © OpenStreetMap contributors, available under the Open Database License (ODbL). Geocoding is provided by OpenStreetMap's Nominatim service under its usage policy, and base map tiles are served by OpenFreeMap. If you extract and redistribute map data obtained through StreetPainter, the ODbL's share-alike and attribution obligations fall on you.
Google
Sign-in uses Google OAuth and is subject to Google's terms. Hosting is on Google Cloud Platform.

We are not responsible for third-party services, their availability, or what they do with data you have given them directly.

08No warranty

StreetPainter is provided "as is" and "as available", with no warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation.

This is a side project run by one person on a small budget. It may go down, lose a day's imports, compute your coverage wrongly, or stop existing. Use it in that spirit.

Some jurisdictions do not allow certain warranties to be excluded. Where that is true, this section applies only as far as the law permits, and your statutory consumer rights are not affected.

09Limitation of liability

To the fullest extent permitted by law, the operator is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, lost opportunity, or personal injury, arising out of or connected with your use of StreetPainter — including injury or loss suffered while following a planned route.

Where liability cannot be excluded, the operator's total liability to you for all claims is limited to the greater of the amount you paid for the service in the twelve months before the claim (currently nothing) or 50 USD.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

10Ending it

You can leave whenever you like. Use Delete my account on your profile page; it erases your data as described in the Privacy Policy. Export first if you want a copy.

We can suspend or terminate your access if you break these terms, if we are required to by law, or if we shut the service down. If we shut it down, we will give you reasonable notice and a window to export your data.

Sections 5 (as to the licence already ended), 8, 9, 12 and 13 survive termination.

11Changes to the service and these terms

We add, change and remove features. We may do that without notice, though we will not deliberately break something you rely on if there is an alternative.

When these terms change, the "Last updated" date changes. For a material change we will email account holders before it takes effect. Continuing to use StreetPainter after that means you accept the new terms. If you do not, delete your account.

12Governing law

These terms are governed by the laws of [GOVERNING JURISDICTION — e.g. the State of California, United States], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except that consumers keep any right they have to bring proceedings in their own country of residence.

If any provision of these terms is found unenforceable, the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it.
